Just say no

This letter is to voice our objections to the request by RMRC (Rocky Mountain Recreational Communities) for a variance from the current RC-1 zoning in Harbor Village, Bigfork.

These Florida developers want to reduce the current requirements by half, which results in 25-foot lots with 10-foot setbacks in front and back and 2 feet on both sides!

This idea is absolutely ludicrous, outlandish and will do massive harm to this area. It is simply not compatible with Bigfork nor with Harbor Village community itself.

We, as well as the other homeowners in Harbor Village, purchased our land and built our homes in this particular area because this area that they are trying to build on, was advertised as a "motorcoach rally area" and a common park for the homeowners and residents of Harbor Village to use. See attached copy of the original site plan they used to sell their property to us.

It is referred to on page 5, item 11, in the homeowners CCR's as follows: "Community Area," "Community Areas," and "Common Areas" shall mean (a) all Association Land: (b) all land, if any, adjacent to Eagle Bend West Subdivision, now known as Harbor Village which Declarant, by this Declaration or other recorded instrument, makes available for general use by Owners, including but not limited to the Rally Area; and (c) all land or right-of-way easements within Eagle Bend West Subdivision, now known as Harbor Village, including but not limited to the Roadway System, which are dedicated to the public or to a Municipal authority, but which such Municipal authority or other governmental agency requires the Association to maintain. The term "Community Area" does not include Water Resources (unless such Water resources are located on Association Land) or Offsite Water Features.

The values of the homes in Harbor Village are in excess of a million dollars and RMRC is trying to build condos in the 'rally area' that was originally designed for the Homeowners Association use. The proposed houses are going to be 20 square foot "boxes" with no parking facility, and high density that will impact this whole area including Bigfork, Eagle Bend North and East.

We respectfully request that the board please consider the 'right' of the homeowners of Harbor Village

The board should be aware that this past summer, the homeowners had several meetings with RMRC, in our pavilion and rally area, regarding the possibilities of them building something in our rally area. RMRC told us at that time they had nothing permanent in place. Nothing was to happen until the summer of 2006 and before that happens, RMRC would show the homeowners their proposals. Now that the majority of homeowners in Harbor Village and Eagle Bend have left for the winter months they cannot be reached by mail or telephone. RMRC has conveniently submitted plans to the Flathead County Board of Adjustment, for approval of their project unbeknownst to most of the homeowners.

RMRC have proven that they are quite unethical and underhanded and this should play an important role in the board's decision!

Again, please do not approve this request for variance by RMRC.

Something certainly stinks in Harbor Village, Bigfork!

We, the homeowners, feel that the public needs to know what exactly is going on there.

Of course we do not have the massive funding that RMRC has…we are just the homeowners trying to fight the RMRC developers, and the big money backing them.

We hope you will do whatever you can to help us in defeating this ridiculous project.
