A 24-year-old Whitefish man has admitted raping a baby sitter in a case in which his wife also is charged.

Kory Hubble and Nadine Lyons (formerly Hubble), 21, both were accused of providing a 15-year-old girl with marijuana and alcohol before performing sexual acts on her on Nov. 17, 2011.

Hubble pleaded guilty May 30 to a felony charge of sexual intercourse without consent. A sentencing hearing has been set for Aug. 29.

In a separate hearing recently, Lyons attempted unsuccessfully to plead guilty to her charge of felony sexual intercourse without consent.

While on the stand during that hearing, Lyons said she had fallen asleep breastfeeding and was awakened by a naked Hubble, who led her to a back room where the girl was. However, Lyons claimed that subsequent sex acts fell short of actual intercourse between the girl and herself.

Lyons was trying to enter her plea without the benefit of a plea agreement so that she could argue for a probationary sentence. Because of the legal snafu, the hearing was vacated and her case left on the trial term set to begin June 18.

Both Lyons and Hubble are facing between 4 and 100 years in prison and fines of up to $50,000.

Hubble and Lyons are currently in the middle of divorce proceedings that began after their arrest on the rape charges.
