C-Falls man charged with DUI No. 4

A 37-year-old Columbia Falls man pleaded not guilty March 7 to a felony charge of DUI No. 4. Daniel Malloy faces from 13 months to five years and $1,000 to $10,000 if convicted.

According to court records, Malloy was detained by a sheriff’s deputy and a highway patrol trooper at the Zip Trip gas station on U.S. 93 south of Kalispell.

The arresting Kalispell police officer reported smelling alcohol and that Malloy’s eyes were red and glassy. Malloy allegedly failed a field sobriety test and had a 0.103 blood alcohol level at the county jail. He also had prior DUI convictions in February 1996, March 2007 and August 2009.

Malloy was released with a SCRAM monitor and on condition he attend a 24/7 sobriety program. His next hearing is scheduled for June 12.
