Man denies assault with weapon charge
A 48-year-old man has pleaded not guilty to felony assault with a weapon in Flathead District Court.
Tim Andrew Kilpatrick was charged after allegedly brandishing a gun and following two women and a child in July. A jury trial is set for Jan. 16.
On July 30, Flathead County Sheriff’s Office deputies were dispatched to a report of an assault with a weapon, according to court documents. A deputy met with three people, one of whom said that earlier in the evening Kilpatrick had been “acting very strange and talking to himself.” The woman told the deputy that he knocked on her door and reportedly “demanded to know if there was a problem.” The woman then decided to leave her residence along with her son and a friend, court documents state.
The group was attempting to leave in the woman’s vehicle when Kilpatrick allegedly came out of the residence waving a handgun and yelling. Realizing she couldn’t pull out of the driveway without going by Kilpatrick, the group left the vehicle and walked in the opposite direction, court documents state. Kilpatrick was said to have followed them until they were able to get inside another neighbor’s residence and ask for help.
Deputies spoke with Kilpatrick, who allegedly admitted brandishing the handgun, reportedly stating he did so because the woman “drove too fast on their road.” Kilpatrick also reportedly said he knew that he should not have retrieved the firearm but should have called law enforcement instead.
Officers reportedly located a loaded revolver on the ground near Kilpatrick, who was described as uncooperative and appeared intoxicated.
